Terms of Service

These terms govern use of Moon, the recruiting workspace at app.getmoon.ai. By using Moon you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
1. The service
Moon helps talent teams source candidates, run outreach, schedule interviews and record decisions. We may change or improve features over time; we will not materially reduce what a paying customer receives during their term without notice.
2. Your account
You are responsible for the accuracy of your account details, for keeping your credentials secure, and for what happens under your account. Tell us promptly at services@moon.ac if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- use Moon to send unsolicited bulk messaging unrelated to a genuine hiring process;
- upload unlawful, discriminatory or harassing content, or use Moon to discriminate against candidates on any protected characteristic;
- record an interview without meeting the notice and consent requirements that apply where the participants are;
- reverse-engineer, resell, or attempt to extract the underlying models or source code;
- probe, scan or overload the service, or bypass any access control.
4. Candidate data and your responsibilities
You decide which candidates go into Moon and what is stored about them. You are the controller of that data and are responsible for having a lawful basis to process it, for honouring candidate rights requests, and for complying with employment and privacy law where you and your candidates are located. Moon acts on your instructions as your processor.
5. AI-assisted output
Moon uses AI to draft messages, summarize interviews and score candidates against a role. These are drafts and suggestions, not decisions. A human on your team reviews and sends every candidate-facing message, and makes every hiring decision. You are responsible for what you send and for the decisions you make. AI output can be wrong — check it.
6. Third-party services
Moon connects to services you authorise, including Google Calendar, email and messaging providers, and applicant tracking systems. Your use of those services remains governed by their own terms. We are not responsible for their availability or their acts.
7. Fees
Paid plans are billed as set out in your order form or subscription. Fees are non-refundable except where the law requires otherwise. We will give notice before a price change takes effect at renewal.
8. Intellectual property
Moon and everything in it — software, design, documentation — remain ours. Your data remains yours; you grant us only the licence needed to operate the service for you. You may export your data at any time while your account is active.
9. Confidentiality
Each side will protect the other's confidential information with at least reasonable care and use it only to perform under these terms.
10. Availability
We work to keep Moon available and reliable, but we do not promise uninterrupted service. Maintenance, provider outages and events outside our control can interrupt it. Any uptime commitment is in your order form.
11. Warranties
Moon is provided "as is". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that AI output is accurate, complete, or suitable for any particular hiring decision.
12. Limitation of liability
To the extent the law allows, neither side is liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability arising from these terms is capped at the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
13. Termination
You may stop using Moon at any time. We may suspend or terminate an account that breaches these terms, or where we must for legal or security reasons. On termination we delete or return your data as described in the Privacy Policy.
14. Changes
We may update these terms. Material changes will be notified to account administrators before they take effect; continuing to use Moon after that means you accept them.
15. Governing law
These terms are governed by the laws of the State of California, United States, and the state and federal courts located in Contra Costa County, California have exclusive jurisdiction, without regard to conflict-of-law rules.
